Why this legally can't be called 'ice cream'

Dairy Queen doesn't technically sell 'ice cream' and it all comes down to milkfat. According to FDA rules, anything labeled 'ice cream' must have at least 10% milkfat. Dairy Queen’s soft serve only has 5%, which means it's legally in a different category.
